These terms govern your relationship with Nomad Adventure Treks and Expeditions and should be read in detail before any bookings or participations are made.
1. Terms of Agreement
You shall agree to these Terms and Conditions, along with any subsequent changes, as you navigate our website and avail of our services. If these terms are unacceptable to you, kindly do not proceed to utilize the mobile app or website or book for services.
2. Booking and Payment:
2.1 Booking Process:
While booking a trek or expedition with us, you are required to provide your personal information, which should be accurate. This includes your full name, contact information, health conditions, and any other information that may be pertinent to the activity. Also, you have to confirm that you qualify in the physical and fitness standards for the selected trek.
2.2 Payment:
To confirm your booking, we require a deposit or full payment. Payment can be made through credit card, bank transfer, or through our accredited payment service providers. All payments are made securely, and a confirmation email is sent after a successful payment.
2.3 Cancellation Policy:
For any cancellations, we would appreciate notice at your earliest convenience. Cancellations over 30 days prior to the departure date are eligible for a full refund with a small administrative charge. Cancellations 30 to 15 days prior to departure will incur a 50% refund, and cancellations within 14 days of the departure date are non-refundable.
2.4 Changes to Booking:
You may contact us for any changes to the booking details, including dates and trek information. All changes will depend on availability and may incur extra costs.
3. Fitness and Health Preconditions
Before reserving a trek for your safety, you must share any special medical conditions, special fitness concerns, or requirements you may have. Some treks may be more challenging, as they may require you to be fit and have a great deal of stamina, in which case you may need to supply a medical certificate confirming that you are fit for the selected trek.
If you fail to meet the health or fitness standards set, rest assured that your booking will be canceled and non-refundable.
4. Liability and Responsibility
4.1 Trek Risks
Risks associated with trekking and expeditions include, but are not limited to, accidents, diseases, injuries, and loss of personal belongings. You understand and accept these risks when engaging in our activities.
4.2 Waiver of Liability
You waive any right to claim against Nomad Adventure Treks and Expeditions, their employees, agents, and associates for any injury and damages or losses that happened to you during the trek, including transportation, accommodation, and adventure activities.
4.3 Travel Insurance
To guard against expenses incurred from cancellations and delays, Nomad Adventure Treks and Expeditions suggest getting comprehensive travel insurance that includes medical care, accidents, trip cancellations, and lost luggage coverage. We do not take responsibility for cancellation fees or travel delays.
5. Conduct During the Trek
This behavior includes taking into account local culture, the environment, and other trekkers. Your safety and the success of the trek greatly depends on the instructions of our guides and staff which you are required to always follow.
5.1 Responsible Conduct During Trek
We foster eco-friendly trekking behaviors. It is necessary to observe local culture, refrain from waste disposal, and protect the environment. Damage caused to the environment, vegetation, and wildlife may result in the termination of engagement with no reimbursement of fees.
5.2 Substance Abuse:
Use of illicit drugs or consumption of too much alcohol while on the trek is not allowed. This behavior will result in disqualification from the trek with no fees paid being reimbursed.
6. Cancellation or Alterations to the Trek
We reserve the right to cancel or change the itinerary plan of any trek or expedition if some issues arise, like a natural calamity, unrest in the region, adverse meteorological phenomena, or any other issue that compromises the security or logistics of the trip. For these reasons, we will offer other types of solutions, like postponing the trek to another date or returning the money without conditions.
7. Privacy Policy:
We will protect your privacy and personal data. Any personal information, such as medical records, payments, and other information you provide, will be subjected to our Privacy Policy on how we capture, save, and use your information.
8. Intellectual Property
Nomad Adventure Treks and Expeditions owns and controls all content, including logos, text, images, and graphics, on our website. None of the aforementioned content can be used, copied, or disseminated without our explicit written authorization.
9. Liability
Nomad Adventure Treks and Expeditions assumes no liability for delays or interruptions in service or cancellation of treks that result from events outside of our control. This may include, but is not limited to, catastrophic fires and other natural disasters, civil unrest, war, strikes, and any violence that may compromise the safety or enjoyment of the trek.
10. Governing Law and Dispute Resolution
These terms and conditions are subject to the laws of the jurisdiction of any country, where we run operations. Such disputes will be dealt with through arbitration or mediation within the location we operate in.
11. Changes to Terms and Conditions
Nomad Adventure Treks and Expeditions will notify you of any changes and updates regarding the said terms and conditions on our website. Updated documents will be applicable to any subsequent services or bookings made.
